The terms that govern your use of NodeGuard's Cloud VPS, Web Hosting, WordPress Hosting and Secure VPN services.
These Terms and Conditions ("Terms") govern your access to and use of the services provided by NodeGuard ("NodeGuard", "we", "us" or "our"). By ordering, accessing or using any NodeGuard service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services.
NodeGuard provides Cloud VPS hosting, shared Web Hosting, managed WordPress Hosting, and Secure VPN services, along with related infrastructure such as DNS and support tooling. We may introduce, modify, or discontinue individual services or features at any time, and will make reasonable efforts to notify customers of material changes that affect active subscriptions.
To use our services you must register an account and provide accurate, current and complete information. You are responsible for keeping your login credentials secure and for all activity that occurs under your account. You must notify us promptly if you suspect unauthorized access. You must be at least 18 years old, or hold the authorization of a parent or legal guardian, to hold a NodeGuard account.
Services are billed in advance for the billing cycle you select at checkout (monthly or annually, depending on the plan). You are responsible for keeping your payment details up to date. Late or failed payments may result in a short grace period followed by service suspension, and continued non-payment may lead to termination and removal of associated data. You are responsible for any taxes, duties or similar charges applicable to your purchase.
If you believe you have been billed in error, please contact us before opening a payment dispute or chargeback with your bank or card provider — most billing issues can be resolved quickly and directly. Chargebacks that we consider unjustified may result in immediate suspension of the associated account while the matter is investigated.
Unless a specific money-back guarantee is advertised for a plan, service fees, setup charges, domain registrations and third-party licenses are generally non-refundable once a service has been provisioned. Where we advertise a money-back period for a plan, refund requests made within that window will be honored according to the terms stated at checkout. Outside of an advertised guarantee, we may still issue a partial or full refund at our discretion where there has been a genuine and serious service failure on our part.
You agree not to use NodeGuard services to engage in, host, or facilitate:
We may suspend or terminate a service immediately, without prior notice, where we reasonably believe it is being used in violation of this section.
Our Secure VPN service is intended for lawful privacy and security purposes only. It must not be used to conduct criminal activity, infringe copyright, distribute spam, or attack third-party networks. While we design our VPN service to protect your privacy, we do not and cannot guarantee absolute anonymity, and we may be required to respond to valid, lawful requests from competent authorities.
You are responsible for maintaining your own backups of any data, files, configurations, or content hosted on our services. Where we offer backup features, these are provided as a convenience and are not a guarantee against data loss. We recommend keeping an independent copy of anything you cannot afford to lose.
We work to maintain high network and platform availability and target a 99.9% uptime standard for our infrastructure, but we do not guarantee uninterrupted or error-free service. Planned maintenance, hardware failure, upstream provider issues, security incidents, and events outside our reasonable control may affect availability. Where an uptime guarantee applies to your plan, any remedy is limited to service credit as described in the applicable plan terms, and does not extend to interruptions caused by your own configuration, software, or actions.
Where DDoS protection is included with a service, it is provided on a best-effort basis using the mitigation tools available to us. We do not guarantee that every attack will be fully mitigated or that service will remain uninterrupted during an attack.
We may suspend or terminate your access to any service for breach of these Terms, non-payment, to protect the security or integrity of our network, or to comply with a legal obligation. In serious cases — such as active abuse, security threats, or illegal content — we may act without prior notice.
To the fullest extent permitted by law, NodeGuard will not be liable for indirect, incidental, or consequential damages, including lost profits, lost data, or business interruption, arising from your use of our services. Our total liability for any claim relating to a service will not exceed the amount you paid us for that service in the three (3) months preceding the claim.
You agree to indemnify and hold harmless NodeGuard, its staff and contractors from any claim, loss, or expense arising from your use of our services, your content, or your violation of these Terms.
All NodeGuard trademarks, branding, software and website content remain our property. You retain full ownership of the content and data you host with us.
Our collection and use of personal data is described in our Privacy Policy, which forms part of these Terms.
We are not liable for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, power or internet outages, government action, or cybersecurity incidents affecting third parties we rely on.
We may update these Terms from time to time. Continued use of our services after an update takes effect constitutes acceptance of the revised Terms. Where changes are material, we will make reasonable efforts to notify active customers.
These Terms are governed by the laws applicable in NodeGuard's country of registration, without regard to conflict-of-law principles, and any disputes will be subject to the exclusive jurisdiction of the courts of that country.
Questions about these Terms can be sent through our contact page. For account-specific or technical support matters, existing clients should use the support ticket system in the client area.
